European Union takes legal action after Poland violates bloc laws

The European Union (EU) announced on Wednesday that it is taking legal action against Poland for violating the bloc’s law and undermining judicial independence. EU economy commissioner Paolo Gentiloni said that they decided to take legal action against Poland because it broke the primacy of EU law.

The announcement came at a time when there is an ongoing dispute between Brussels and Warsaw over judicial independence. The announcement increased the long-running dispute between Warsaw and Brussels. The first step of the legal action will be taken in a formal way. The commission will send a letter to Poland to get more information from the country.

EU Commission on Poland’s Constitutional Tribunal

The EU Commissioner said Poland's Constitutional Tribunal violated EU laws. However, Poland’s Deputy Justice Minister Sebastian Kaleta denied such claims. He said the EU made the announcement to attack the Polish constitution.  Former Prime Minister of Poland, Beata Szydlo also said, “This is no longer a legal dispute, it is an attack on the Polish constitution.” He further claimed that the EU is attacking the foundations of Polish statehood.

According to The Guardian, Poland agreed on the supremacy of EU law when it became a member of the bloc in 2004. However, when the new government, Beata Szydło came to power in 2015, it challenged the principle of the EU while bringing domestic courts under political control.

European Union’s legal action

The EU’s legal action is in response to the October ruling. In October, Poland’s constitutional court ruled that Polish laws have supremacy over the EU laws in areas where they conflict. According to  Associated Press, the EU commissioner said that European Union is a community of values and of law. The commissioner further added that the rights of Europeans must be protected under the EU law, no matter where they live in the union.
